1. The Builder
Throughout these terms The Builder will refer to Win A Builder UK Limited (Company No: 14029911), whose registered office is 101 North Mersey Business Centre, Woodward Road, Liverpool, United Kingdom, L33 7UY.

2. The Competition
2.1. these terms and conditions apply to all competitions listed on the Builder’s website at www.winabuilder.co.uk (referred to in these terms as the “website”)
2.2. All competitions are skill-based competitions. Entry fees for online entries are payable each time you enter. Where The Builder offers an easy or multiple choice question a free entry route will be available.
2.3. To have a chance of winning, everyone who enters the competition (an “Entrant”) will be required to correctly answer or solve a problem set by the Builder (known as the “Competition Question”)
2.4. Additional terms for individual competitions will be accessible from the specific competition entry page and will apply as well as these terms. Where there is a conflict between these terms and the individual competition terms, the individual competition terms will take precedence.
3. How to Enter
3.1. The competition will run from and including the opening and closing dates specified on the Website. These dates shall be referred to as the “Opening Date” and “Closing Date” respectively. All times and dates referred to are the times and dates local to the competition in question (usually GMT).
3.2. If the Builder feels it necessary to do so (i.e., not meeting costs of running the competition), the Builder reserves the right to change the Opening and/ or Closing Dates. If this were to happen, the new details will be displayed on the Website and the competition shall ‘Roll Over’.
3.3. The Builder must receive all competition entries by no later than the specified time on the Closing Date. Any competition entries received after the specified time on the Closing Date will be disqualified without refund.
3.4. The maximum number of entries to any competition will be stated on the competition page of Website. In this case the number of entries you are able to make may be limited.
3.5. Entrants may take part in each competition as many times as they wish until the maximum number of entries per user have been submitted and until the maximum number of entries for the competition has been reached. Entrants submitting free entries via the free entry route may enter in accordance with the Free Postal Entry Terms & Conditions .
For online entry to the competition:
On the Website, Log in or Register
Then, view the competition question;
Select your answer to the competition question then choose the number of tickets you wish to enter;
Complete the checkout process and submit an online registration form or log into your account;
Complete the payment to receive confirmation of your order.
3.6. This process can be completed as many times as you wish, up to the maximum number of tickets allowed per Entrant, or until the total amount of tickets for that individual competition has been allocated.
3.7. All Entries must be submitted in the English language. Entries in languages other than English will automatically be disqualified and no refund will be given.
3.8. Unless you are using the free entry method, the Builder will confirm that your entry has been received and allocate your ticket number(s). Only free postal entries selected at random in the ballot for the free entry ticket allocation of each competition will be notified and ticket numbers allocated.
3.9. By purchasing tickets and submitting a competition entry, you enter into a contract with the Builder and are agreeing to be bound by these terms and conditions.
3.10. The Builder will neither accept any liability or responsibility for competition entries that are not successfully completed, are lost or are delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
3.11. If an individual competition Prize is not claimed as specified below in item 7.4 of these terms, then the prize will be added too and there will be a Roll Over individual competition where all the entrants from the original competition will be given a free entry into the competition and notified of further chances to win the Roll Over.
3.12. You may enter the competition via the free entry method. In doing so, you agree to the Free Postal Entry Terms & Conditions
3.13. There will be a limited number of free entry tickets for each individual competition (this number will be displayed on the individual competition page), these will be selected at random from the postal entries received and allocated before the draw takes place.
3.14. Incomplete or ineligible free postal entries will be disqualified.
3.15. By entering the competition, you are confirming that you are eligible to enter and agreeing to all the terms and conditions set out on this Website.
4. Selecting a winner
4.1. All entrants with purchased tickets who correctly answer the competition question will be placed into a random draw to select the winner (automated draw, live draw or instant prize) for that individual competition.
4.2. Each individual competition will have a limited number of free entry tickets allocated to the winning draw, these will be randomly selected and allocated from the list of free postal entries for that individual competition (provided all criteria and terms have been met).
4.3. The random draw to select a winner (winning draw) will take place as soon as reasonably possible and, in any event, within 14 days of the Closing Date for that individual competition.
4.4. All Entrants will have their entry numbers included in a spreadsheet which may be published on the Website and will be visible during the live draw. The Builder will accept no liability or responsibility if basic entry details (name and ticket number) are published during a live draw.
5. Eligibility
5.1. Each individual competition is only open to residents in the United Kingdom aged 18 years or over, except:
5.1.1. Employees of the Builder;
5.1.2. Employees of agents of the Builder who are professionally connected with an individual competition or its administration; or
5.1.3. Members of the households of (a) and (b) above.
5.2. By entering any individual competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Builder may require you to provide proof that you are eligible to enter the individual competition and claim the prize. If you fail to provide the Builder with any such proof, or other required information or proof relating to the individual competition terms or these terms and conditions within a reasonable time, you may be disqualified from the competition (even if you have been drawn as a winner by this time).
5.3. By entering any individual competition, the Entrant confirms that they have ownership or written permission from legal ownership to receive a prize where a property may be altered (renovated) when doing so.
5.4.Any written prize may be forfeit if written proof is not received when required (for instance a tenant wins, and landlord refuses prizes etc).
5.5. The Builder will not accept competition entries that are:

5.5.2. Automatically generated by computer; or
5.5.3. Incomplete.
5.6. The Builder reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition. This includes if you are rude or abusive to the Builder or anyone associated with them or their trades or suppliers.
5.7. Subject to clause 11.3 below, no refunds of the entry fee will be given in any event, including;
5.7.1. If, following your entry into the competition, the eligibility criteria for entering the individual competition or claiming the Prize changes and you are no longer eligible; or
5.7.2. If, following your entry into the individual competition, you subsequently find out that you are not eligible to enter the competition or claim the Prize; or
5.7.3. If you are disqualified from the competition by the Builder for any reason.
5.7.4. If the Entrant engages in any of the following:
5.7.4.1. Any form of fraud (actual or apparent);
5.7.4.2. Fraudulent misrepresentation;
5.7.4.3. Fraudulent concealment;
5.7.4.4. Hacking or interference with the proper functioning of the website; or
5.7.4.5. Amending, or unauthorised use of, any of the code that constitutes this website.

5.7.5. If the Prize is a construction prize, and the Entrant has not shown substantial proof of ownership (or written permission from ownership) of the property where the prize is to be installed.
6. The Prize
6.1. The prize for each individual competition is described on the individual competition page on the Website (the “Prize”). Details of the Prize are, to the best of the Builder’s knowledge, information and belief, correct as at the Opening Date of the competition in question.
6.2. Prizes are subject to availability. The Builder reserves the right to substitute any prize with a prize of equal value. If any details of the Prize change, the Builder will endeavour to update the Website as soon as reasonably possible.
6.3. The Builder makes no representations and gives no warranties about the Prize, its value, its condition or any other information provided on the Website. The Builder makes no representations and gives no warranties that the information provided on the Website is accurate, complete or up to date. If the Prize is of a construction type:
6.3.1. No insurance is included in the supply of any Prize. Although all trades and suppliers will be vetted, it is the Winner’s responsibility to complete their own checks to ensure the suppliers still have adequate cover to undertake the works.
6.3.2. The Builder has no responsibility for the Prize once the supplier has been contracted to supply or complete the works and all relevant responsibilities will lie with the supplier of the Prize.
6.3.3. The chosen supplier (or trade contractor) of the prize, along with the winner of the prize will be responsible for complying with all relevant laws and regulations relating to the supply and or installation of the Prize.
6.3.4. The Builder will make reasonable checks that the chosen suppliers (or trade contractors) are capable of supplying the Prize before contacting them in relation to the Prize and supplying details of the winner so they may complete their own eligibility checks.
6.3.5. The suppliers or trade contractors are solely responsible for ensuring all health and safety regulations are met and all equipment and clothing provided while they provide the prize in question.
6.3.6. The suppliers or trade contractors are solely responsible for ensuring all relevant building regulations are met and complied with while they provide the prize in question.
6.3.7. The Winner and Suppliers or Trade contractors are responsible for arranging the completion of the stated prize within the limit of the value of the prize.
6.3.8. Some Prizes will have a ‘or Cash Alternative’ shown on the individual competition. Winners of these Prizes may exchange their prize for the Cash Alternative amount shown.
6.3.9. All relevant documentation, certification etc in relation to the Prize will be the responsibility of the Suppliers or Trade contractors to deliver and we have no control or responsibility of this.
6.4. The Prize may be provided, supplied and or fitted by a third-party supplier (the “Supplier”). Details of the Supplier(s) (if any) will be provided to the Winner by the Website. The Suppliers will also be given the Winners details to arrange delivery or installation of the Prize.
6.5. The Builder reserves the right to substitute the Prize for an alternative cash prize (“Cash Prize”) in most circumstances (not including sponsored Prizes) including:
6.5.1. The Prize becomes unavailable;
6.5.2. A suitable Supplier (local to the Winner) cannot be obtained;
6.5.3. A suitable Supplier cannot complete the Prize within the price limit of the Cash Prize equivalent amount
6.5.4. Other circumstances beyond the reasonable control of the Builder make it necessary to do so; 6.6. The prize amount is not negotiable or transferable.
7. Winners
7.1. The decision of the Builder is final, and no correspondence or discussion will be entered into.
7.2. The Winner’s name will be announced during the winning draw. If you wish for your name to be censored during any live draw, you must contact the Builder via email (security@winabuilder.co.uk) as soon as possible after you have completed your entry and, in any event, at least 48 hours before the live draw takes place. The Builder will accept no liability or responsibility if details are published after this time.
7.3. The Builder will contact the winner personally as soon as practicable after the Draw Date using the telephone number or email address provided with the competition entry.
7.4. If the winner cannot be contacted, is not available or has not claimed the prize within 14 days of the Draw Date the Builder reserves the right to withdraw the prize offer and add the prize back to another individual competition as a roll over competition (“Roll Over”)
7.5. The Builder will either publish or make available information that indicates that a valid award took place. To comply with this obligation the Builder will publish the full name and county/ town of residence of major prize winners on the Website.
7.6. If you object to any or all of your surname, county/ town of residence and winning entry being published or made available, please contact the Builder via email (security@winabuilder.co.uk) prior to the Closing Date. In such circumstances, the Builder must still provide the information to the Advertising Standards Authority if requested.
8. Claiming the Prize
8.1. You must claim the Prize personally. The Prize may not be claimed by a third party on your behalf. Details of how the prize for each individual competition will be delivered or made available to you will be discussed or sent to you via email once you have formally claimed the Prize.
8.2. If your personal details, including contact information, changes at any time you should notify the Builder as soon as reasonably possible. Notifications should be sent to the Builder via email. Notifications must include details of the competition you have entered, your old details and your new details. If your details change within 10 days of the Closing Date, the Builder will use your old details if it needs to contact you.
8.3. Any Cash Prize will be transferred directly to the winners nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days will result in disqualification from the competition and the winner forfeiting the prize. In such circumstances, the Builder reserves the right to revoke the Prize offer and add the Prize to a separate Roll Over competition.
8.4. The Builder will not accept any responsibility and will not be held liable to pay any compensation if you are unable to, or do not take up the Prize.
8.5. If the Prize is a construction prize, and the winner has completed all eligibility checks (including but not limited to item 5 and all sub items in these terms), the Builder will contact the winner to discuss the Prize and select an appropriate supplier to implement the Prize for the winner. Once the selected supplier is confirmed, the Builder will then pass responsibility to the supplier to arrange to supply/ install the Prize for the winner (up to the value amount of the Prize).
8.6. Once a Prize has been fully Supplied, and the winner has signed a winner satisfaction certificate, the Supplier can then produce the Winner Satisfaction Certificate to the Builder and will be paid for the Prize by the Builder. This gives protection for our Winners and ensures their Prizes are provided/ installed to the winner’s satisfaction and in line with our standards.
8.7. If the selected Supplier cannot supply the Prize to the winner due to its costs exceeding the max value of the Prize, then the Winner may alter the project with the supplier to suit the max value of the Prize. The Winner can also to arrange to pay the Supplier of the Prize for any difference in cost.
8.8. If the Competition Prize has a ‘Cash Alternative’ then the Winner may request to simply have the Cash Alternative transferred to them provided they comply with these terms (including but not limited to point 8.3)
9. Limitation of Liability
9.1. Insofar as is permitted by law, the Builder, its agents or distributers will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of accepting and taking up a prize from any competition except where it is caused by negligence of the Builder or that of their direct employees. Your Statutory rights are not affected.
10. General Data protection and publicity
10.1. By entering any competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Builder or its agents and suppliers to administer the competition or as otherwise set out in the Builder’s Privacy Policy, a copy of which is available on the Website.
10.2. If you are the winner of the competition, you agree that the Builder may use your name, image (of prize at the least) and town or county of residence to announce the winner of this competition. You further agree to participate in any reasonable publicity required by the Builder.
10.3. If you do not wish to participate in any publicity, you must notify the Builder prior to the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in any publicity about the competition, we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the competition has been properly administered and the Prize awarded.
10.4. If you are the winner of the competition, you will be required to provide further personal information via winner’s verification. Proof of your identity may be required in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You will also be required to prove ownership or written legal authority (by the owner) to have a construction Prize installed at your address. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such a way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Builder reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.
10.5. Please note that under data protection laws you are entitled to request that the Builder does not contact you and removes your details from its database. If you make such a request, you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the competition. If you do not wish any of your personal details to be used by the Builder for promotional purposes, please email (security@winabuilder.co.uk) the Builder at prior to the Closing Date.
11. General
11.1. The Builder reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be available on the Website.
11.2. If there is any reason to believe that there has been a breach of these terms and conditions, the Builder may, at its sole discretion, reserve the right to exclude you from participating in the competition and any future competitions.
11.3. The Builder reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so for circumstances out of its control. In such circumstances, the Builder will refund any entry fees you have paid.
11.4. The competitions on the Website are in no way sponsored, endorsed, administered by or associated with Facebook or any other social media outlet. By entering the competitions, Entrants agree that Facebook or any other social media outlet has no liability and is not responsible for the administration or promotion of the competitions.
11.5. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
11.6. You should print a copy of these terms and conditions and keep them for your records.
